The Public Prosecutor’s Office will request two years in prison and special disqualification from exercising the right to passive suffrage during the time of the sentence, and as an accessory penalty, special disqualification from exercising professions or trades related to minors during the time of the sentence (in addition to paying the costs), for E.M.R., who worked as director and carer at the María González Reche Nursery School, in the town of Oria.
As for civil liability, the accused is claimed one thousand euros in compensation to the family.
This is what can be deduced from the written statement of the Court of First Instance and Single Instruction of Purchena, to which Reporters News has had access, where the Ministry of Education of the Andalusian Regional Government is listed as a subsidiary civil party responsible.
In the conclusions, the justice system determines “that the caregiver and director of a nursery school in the town of Oria, had under her care children between one and three years of age. Since the beginning of 2019, the accused E.M.R., maintained a violent and intimidating behaviour towards the children in her care, using inappropriate expressions towards them and repeatedly subjecting them to incorrect, inadequate and humiliating treatment. This conduct – the statement continues – was extended to all the children, but specifically to a child born in 2018, so that the accused, taking advantage of the enclosed space of the classroom and the young age of the child (which prevented him from repelling such behaviour and clearly verbalising what was happening to his parents) acted repeatedly during the month of September 2020. When the child cried or was restless, he locked him up sitting on a chair in a storage room in the nursery in the dark, with the door half closed and isolated from all his classmates, which destabilised the daily development of the child’s life – who lost his appetite and sleep -, cried continuously in the morning, was frightened in front of third parties and became afraid of the dark”, state the conclusions after investigating the facts.
The facts described constitute a crime against moral integrity, according to the prosecutor’s office, which holds the accused responsible for them.
The aggravating circumstance of abuse of superiority provided for in article 22.2 of the Penal Code is applicable.
