After the UGT trade union filed a contentious-administrative appeal against the Agreement adopted by this council on 9 March 2017, and published in the BOP on 18 April of the same year, by which the General Budget and the staffing table for 2017 were approved, the Albox Town Council has been ruled right.
The General Union of Workers, understood that with regard to the amortisation of four firefighter positions contained in the resolution that was being challenged, it was not in accordance with the law because “it entailed the violation of the right to the position that attends public servants, as it entails the de facto suppression of the Fire Brigade, alleging also that there has been no collective bargaining prior to the modification of the RPT”.
Now the ruling dated 18 November, determines that “rejects the contentious-administrative appeal lodged by the trade union UNION GENERAL DE TRABAJADORES against the Agreement adopted by the ALBOX TOWN COUNCIL, on 9 March 2017, as it is in accordance with the law; all this with express imposition of costs to the appellant”.
UGT argued that there had been no collective bargaining prior to the modification of the RPT, but in the documentation consulted by La Comarca Noticias, it is demonstrated after a testimonial that “there was prior collective bargaining – the Agreement was adopted on 9 March and the meetings were held in February – so this ground of challenge must also be dismissed”.
The judgement is not final and can be appealed.
We recall that the union requested the administrative file and subsequently filed the lawsuit, which was transferred to the corporation, who appeared in the case, answering it through the lawyer Alfredo Najas. With regard to the evidence, both parties requested the reproduction of the administrative file and documentary evidence, and the defendant also requested witness evidence.
