The Court of First Instance of Purchena on April 17, has agreed the dismissal of Antonio Martinez Pascual, mayor of Olula del Rio, Miguel Angel Castellon, then delegate of Development of the Provincial Council, among others, for the works at the roundabout of Olula del Rio and a contract for energy efficiency, a complaint that was filed by the socialist group of this municipality.
Among the background facts reflected in the decision that has finally taken the justice system and which has been accessed by La Comarca Noticias, appears as one of the pieces, «The execution of a work consisting of adaptation of a public space in Olula del Rio – roundabout – charged to provincial plans of the Diputación de Almería by the mercantile OLUMAFI, SL, prior to the awarding of the work to the aforementioned company», for which the local PSOE filed a complaint in 2016, «for an alleged crime of prevarication and against the administration».
As a result of the process and always according to the judicial investigation, «the perpetration of criminal acts is not duly justified», highlighting that «the assumption of the expenditure by the City Council through the Extrajudicial Recognition of Credits 2/2016 was in accordance with the regulatory framework of the Extrajudicial Recognition of Credits, because it was approved by the Plenary of the City Council».
In the same complaint and as a separate piece, the Prosecutor’s Office considered that a criminal case should also be opened to investigate the process of awarding a works contract for the improvement of energy efficiency in the municipality to the company Osepsa by the Olula del Río Town Council.
Now, after five years of investigations, «in view of the results of the investigation carried out in the course of these proceedings, the case has been dismissed as there are no objective indications of the commission of the crime in question, nor of any other criminal offence that could be the subject of investigation».

Once the judicial decision was known, the mayor of the municipality said to La Comarca that «he has always been calm» in the face of a complaint that «has only had the intention of obscuring the municipal management».
«I am satisfied with the result of the investigation because it also reinforces our way of managing and doing things. It is regrettable that the PSOE, just to play politics and try to reach the mayor’s office through the courts, is dedicated to filing this type of complaint. I hope they rectify and take responsibility as they do themselves and the people they want to represent little favours. Olulenses are intelligent enough to know who is who, how the public is managed and the works that have been done and those that are yet to come».
