When subjected to the alcohol detection test, the driver showed a rate of 0.93 mg/l in exhaled air, 6 times higher than the maximum rate established for professional drivers, being investigated for an alleged crime against road safety, for driving a motor vehicle under the influence of alcohol, included in article 379.2 of the Criminal Code, facing a prison sentence of three to six months or a fine of six to twelve months or community service of thirty-one to ninety days, and, in any case, the deprivation of the right to drive motor vehicles and mopeds for a period of more than one and up to four years.
Finally, and after consulting the Civil Guard database, the driver was placed at the disposal of the Investigating Court No. 6 of Almería, as he also had a Judicial Requisition for Search, Detention and Appearance from a Court in Alicante.
