Torrecillas is asked for 2 years and 8 months of disqualification for opacity in the works of the Convent.
The trial will take place on 20 March at Criminal Court No. 1.

The judicial parade of the mayor of Albox Francisco Torrecillas continues and is not yet over given the number of open cases.

The PSOE denounced in 2019 the refusal of the mayor and the municipal comptroller to disclose the accounts of the refurbishment of the Convent, a building currently occupied by the Town Hall.

Now it is the justice system who is asking the mayor of Albox and the Municipal Comptroller, the penalty of disqualification for 2 years and 8 months for employment or public office, accusing them of having violated the civic rights of councillors in the opposition (provided for and punishable under Article 542 of the Penal Code), according to the Prosecutor’s Office brief to which La Comarca Noticias has had access.

The indictment relates how «Francisco Torrecillas Sánchez and Javier Saura Romero, in their capacity as Mayor and Comptroller of Albox Town Council, acting with the aim of preventing the opposition from carrying out their task of auditing and controlling the exercise of the public function effectively, repeatedly failed to provide the information and documentation that the councillors requested on matters relating to the state of execution of the budget carried over from 2017 and the works that were being carried out at the La Milagrosa School, known as El Convento».

«The Prosecutor’s account continues that Francisco Bernardo Carrillo Quilez and Ángel Francisco Pardo Mármol – then PSOE councillors – repeatedly requested relevant information for their opposition work and the performance of their duties as councillors, in response to which the accused – Mayor and Comptroller – voluntarily and in breach of their duties as councillors, requested that the Mayor and Comptroller be informed of the situation, voluntarily and in breach of their obligations, did not reply, replied with evasive answers or replied to the requests without finally giving effective compliance with the councillors’ requests, in such a way that in any case the reply was useless for the work of the opposition».

Specifically, according to the documentation consulted, «on 12 March 2018, councillor Pardo Mármol, presented a letter to the accused Javier Saura in which he requested that

to inform the opposition group – (PSOE) – about the state of execution of the extended budget of the Albox Town Council for the financial year 2017 to date, as well as the specific identification of the expenses made for works/projects within the investment item, without obtaining any information».

«On 24 July 2018, councillor Francisco Bernardo Carrillo -PSOE-, again submitted a letter to the accused Javier Saura, in which he reiterated the previous request in the absence of a reply, requesting that the information be extended to date. However,» continues the Prosecutor, «the requested information was not provided either».

«On 28 August 2018 and five months having elapsed without receiving the information, councillor Francisco Carrillo again submitted a letter to the accused Javier Saura again requesting information on the state of execution of the budget carried over from the 2017 financial year to date, as well as the spending limit for each budget item and whether it had been exceeded. Also on the same date, councillor Francisco Carrillo presented a letter addressed to Mayor Francisco Torrecillas in which he requested that, given the lack of information, the Mayor’s Office take the necessary steps to ensure that the Intervention of the Town Hall would provide them with the information they had repeatedly requested. Despite the requests, this information was not provided».

«In view of the lack of compliance with the request, on 25 September 2018, the councillor Francisco Carrillo presented a new letter to the accused Francisco Torrecillas in which he asked him, in his capacity as mayor, to give the necessary orders to the Intervention of the City Council to provide the information as of the date of signing the letter (25/09/2018). The required information was not obtained either».

«Finally, on 19 October 2018, the councillor Francisco Carrillo, presented a new letter to the accused Francisco Torrecillas in which he reiterated his request for access to the report on the state of execution of the extended budget of the Albox Town Council for the financial year 2017 up to the date of signing the letter (19/10/2018), as well as the spending limit for each item, without obtaining any information.»

«Despite all the requests made and the holding of Ordinary and Extraordinary Plenary Plenary Sessions of Albox Town Council, the accused did not provide at any time the information and documentation requested by the opposition councillors who filed a complaint with the Public Prosecutor’s Office on 18 January 2019 due to the impossibility of fulfilling their functions of supervision and control of the political work».

The facts reported constitute a crime against Civic Rights, provided for and punishable under article 542 of the Penal Code. According to the Public Prosecutor, the accused, Francisco Torrecillas and Javier Saura, are responsible as perpetrators of these acts.

The trial to clarify the denounced facts will take place this coming 20th March at 10 o’clock in the morning at the Criminal Court Nº 1.

It is not the first time that a mayor of Albox sits in the dock for alleged «lack of transparency», with its foreseeable consequences.

Now it will have to be determined how, in what way and if the contracting process was followed as indicated by law, in a work that the PSOE estimated at the time at over 750,000 euros, which led to the respective requests for reports that have never been made available to the then opposition group.
